HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7087 of 2019 ORDER:

1) This Writ Petition is being disposed of at the admission stage with the consent of both the parties.

2) This Writ Petition is filed seeking a writ of Mandamus declaring the action of the respondents in not considering the petitioner's case for compassionate appointment in any suitable post under the scheme, by considering his representations dated 19.12.2013 and 28.03.2017 as illegal, arbitrary and contrary to the scheme of compassionate appointment and sought consequential direction to direct the respondents to consider the petitioner's case for compassionate appointment in any suitable post by considering his representations.

3) Heard Sri Shaik Hameed, learned counsel for the petitioner and Government Pleader for Services-II, for the respondents.

4) It has been contended by the petitioner that the father of the petitioner was employed with the respondents and he died on 31.01.2002. Thereafter, the petitioner submitted a representation to the respondents to consider his case for appointment on compassionate ground, but the respondents have neither considered his case for appointment on compassionate ground nor passed any orders on the said representation.

5) Learned counsel for the petitioner submits that the petitioner has submitted latest representation on 28.03.2017 requesting the

respondents to consider his case for appointment on compassionate ground. Therefore, the counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner in accordance with law.

6) Learned Government Pleader for Services-II appearing for the respondents had contended that the representations submitted by the petitioner would be considered and appropriate orders would be passed in accordance with law.

7) Having regard to the rival submissions, this Court is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 28.03.2017 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

8) As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. __________________________ ABHINAND KUMAR SHAVILI, J 03.04.2019 gkv
