The writ petition was filed by the petitioner-Educational Society for the following relief:
"to issue a writ or order preferably in the nature of Writ or Mandamus declaring the inaction of the respondents in considering the Application dated 06.06.2015 made by the petitioner for opening new courses in Dharmika Degree College commencing from the academic year 2015-16, as illegal, arbitrary and violative of Articles 14 and 19 of Constitution of India and consequently, direct the respondents to consider the application dated 06.06.2015 made by the petitioner for replacement of B.Com (General) and B.A. Courses in Dharmika Degree College with B.Sc. Maths, Physics, Computer Science (English medium), B.Sc., Botany, Zoology, Chemistry (English medium) commencing from the academic year 2015-16 and pass such other order or orders as this Honourable Court deems fit and proper in the circumstances of the case."
The learned standing counsel appearing for the respondents submits that since the relief sought for in this writ petition is in respect of opening of new courses for the academic year 2015-16 and the classes have already been commenced, the cause in the writ petition has become infructuous.
Recording the above statement, the writ petition is dismissed as infrucutous. However, the petitioner is given liberty to file fresh writ petition as and when fresh cause of action arises. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
