THE HON'BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No. 3223 of 2025 ORDER:

This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner/accused No.6, seeking bail in Crime No.907 of 2024 of Rajendranagar Police Station, Cyberabad Commissionerate, for the offences punishable under Sections 8(c) read with Sections 20(b)(ii)(c), 27(A), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 25(1B)(a) of the Arms Act.

Heard Ms.K.Sirivennela Reddy, learned counsel, representing Sri P.Prabhakar Reddy, learned counsel for the petitioner and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent-State. 3.

The case of prosecution in brief is that on 10.09.2024 on receipt of information that some persons are illegally transporting ganja and they would reach Exit No.17 of Outer Ring Road, Rajendranagar, the seizing officer has intercepted the accused, found 258.389 kgs. of ganja and seized the same.

Learned counsel for the petitioner submitted that the petitioner is an innocent person and he did not commit any offence as alleged against him and he was falsely implicated in this crime. She further submitted that the police have not seized the ganja from the petitioner and entire allegations are levelled against the other accused.

She further submitted that the petitioner was arrested on 12.09.2024 and since then he is in judicial custody. He also submitted that police filed charge sheet and the accused Nos.1 and 3 were already enlarged on bail. She further submitted that the petitioner will abide by the conditions, which are going to be imposed by this Court. She also submitted that the petitioner is not involved in any other offence of a similar nature. Therefore, he prays to release the petitioner on bail. 6.

On the other hand, learned Additional Public Prosecutor opposed the bail stating that the petitioner is involved in a grave offence and the police after completion of investigation filed charge sheet. However, he has not disputed about the granting of bail in favour of accused Nos.1 and 3 and about the involvement of the petitioner in any other offence.

Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that the petitioner was arrested on 12.09.2024 and since then he is in judicial custody. Accused Nos.1 and 3 were already enlarged on bail. The Police have already filed charge sheet. Considering the said facts and circumstances, this Court is inclined to grant bail to the petitioner on the following conditions;

i) The petitioner/accused No.6 is enlarged on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the XI Addl. Metropolitan Magistrate, Cyberabad at Rajendranagar, Ranga Reddy District. ii) The petitioner/accused No.6 shall abide by the conditions stipulated under Section 437(3) of Cr.P.C. (presently 480(3) of BNSS).

Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any, pending in this petition stand closed.
