THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.3590 OF 2012 ORDER:

This Writ Petition is filed seeking to direct the respondents to consider the representation of the petitioner for allotment of vacant land admeasuring Ac.0-43 cents in Survey No.1602 situated at Potupalem Gram Panchayat, Gudur Revenue Mandal, SPSR Nellore District, for community purpose.

2. This Court, by order, dated 02.03.2012, directed respondent Nos.2 and 3 to consider the representation of the petitioner and take appropriate action in accordance with law.

3. Counter affidavit is filed stating that pursuant to the order of this Court in W.P.No.788 of 2007 directing respondent No.2 therein to send a report to the Government for alienation of the subject land on payment of market value, proposals for alienation of the subject land in favour of M/s. Kanneganti Sea Foods by fixing the market value at Rs.18,00,000/- per acre were sent to the Chief Commissioner of Land Administration, Hyderabad, who, in turn, submitted the same to the Secretary to Government, Irrigation Department, Hyderabad, on 14.03.2010. It is also stated that the then Sub-Collector, Gudur and Joint Collector, Nellore, inspected the subject land and submitted alienation proposals on payment of market value to the Government. It is also stated that since M/s. Kanneganti Sea Foods has already preferred claim for regularisation of the subject land, which was under

W.P.No.3590 of 2012 ARR,J their occupation, and in view of the directions issued by this Court in W.P.No.788 of 2007, this Writ Petition is liable to be dismissed.

4. Since this Court, by order, 02.03.2012, directed respondent Nos.2 and 3 to consider the representation of the petitioner, it is for the concerned authorities to take the above factors mentioned in the counter affidavit into consideration and pass orders.

5. In view of the same, this Writ Petition is disposed of in terms of the interim order, dated 02.03.2012. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs.
