HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13963 OF 2015 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioner-accused seeking anticipatory bail in connection with Crime No.81 of 2015 pending on the file of S.H.O., S.V.U.Campus Police Station, Tirupathi Urban, Chittoor District registered for the offence under Section 3(1)(x) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989. The petitioner is an Associate Professor attached to Sri Venkateswara University, Tirupathi. The de facto complainant is a member of Scheduled Caste and is the student of the University and the petitioner is her guide for her research in Ph.D. The allegation is that the petitioner harassed the de facto complainant and demanded money and also refused to forward her name for fellowship within the stipulated time. It is further alleged that when she contacted him over phone, he abused her in the name of her caste. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Admittedly, the de facto complainant completed her research and also obtained her Ph.D. What remains in the complaint is that the petitioner herein with an inordinate delay forwarded the complainant's name for fellowship. It is contended by the learned counsel for the petitioner that since there is lack of attendance, the petitioner could not forward her name within the time and the same was also informed to the Vice-Chancellor.

Considering the rival submissions, this Court is inclined to grant anticipatory bail to the petitioner since it will not cause any prejudice for further investigation.

Hence, the petitioner-accused is directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such

surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the likesum to the satisfaction of the Magistrate concerned. Further the petitioner is directed to report before the Station House Officer concerned daily between 10.00 a.m. and 5.00 p.m. for a period of ten days.
