THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.12798 of 2017 ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Civil Supplies appearing for respondents.

In the present Writ Petition, petitioner is challenging the action of the respondents in seizing the cotton seed oil, sunflower oil, palm oil, other oil and deepam oil, worth Rs.3,41,935/-, as illegal and arbitrary and without jurisdiction. Admittedly, in the present case, proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act'), have been initiated against the petitioner and are pending before the second respondent - Collector (Civil Supplies), Rajanna Sircilla District, and an application has already been filed by the petitioner on 07.04.2017 praying for release of the seized stock in the pending proceedings under Section 6-A of the Act and the said application is pending consideration before the second respondent.

In view of the above, this Court deems it appropriate to direct the second respondent to pass appropriate orders on the said application, dated 07.04.2017, filed by the petitioner under

AVSS, J W.P.No.12798 of 2017 Section 6-A of the Act in accordance with law, after giving notice to the persons concerned, within four weeks from the date of receipt of a copy of this order. Pending consideration of the said application, there shall be no sale of seized stock. Subject to the above, the Writ Petition stands disposed of. Consequently, Miscellaneous Petitions, if any pending in this Writ Petition, shall stand closed. No order as to costs. _________________ A.V.SESHA SAI, J 17th APRIL, 2017.
