HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.20920 of 2017 ORDER:

The petitioner prays for the following relief :- " ..... to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus to declare the action of the 2nd Respondent for not considering the representation filed by the petitioner on 19.05.2017 is illegal, arbitrary, contrary to law, unconstitutional and consequently direct the 2nd respondent to consider the representation filed by the petitioner on 19.05.2017 and further direct the 3rd respondent not to register any sale deeds in Sy.Nos.23, 25AA, 62AA, 66, 67, 69, 252, 253, 256 and 259 situated at Nereducharla village and Mandal, Nalgonda District and further direct the 4th respondent not to sanction any lay out permissions ......" The representation was made on 19.05.2017. Now, the inaction is complained by filing the writ petition on 23.06.2017.

This Court is of the view that the prayer for Mandamus to dispose of a representation ought not to go as matter of course. The petitioner could not draw the attention of the Court to a statutory scheme under which the respondents are obligated to pass orders in time schedule. At this juncture, the grievance against non-consideration of representation is premature.

The writ petition is accordingly dismissed. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 28-06-2017 Prv
