THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32950 of 2015 ORDER:
Heard the learned counsel for petitioner and the learned Standing Counsel for respondents.
2. The petitioner was appointed as Shruthiman in the year 1984 and thereafter he was appointed as Vocal Artist Grade-I. At the time of filing the writ petition, he was working as Hindu Dharma Prachara Parishad Programme Co-Coordinator, Adilabad Centre, T.T.D.
Kalyana Mandapam, Adilabad District. It appears that the respondents directed the petitioner to undergo medical examination on 16.06.2010, and in spite of his appearance, no medical examination was conducted. The petitioner states that he was unnecessarily harassed, and though he was appearing before the medical board, he was not being examined. He further states that his transfer to Adilabad was also effected in view of grudge only and in those circumstances, he filed the present writ petition seeking to refer him to the Government Mental Hospital, Erragadda, Hyderabad in order to ascertain whether he is suffering with any physical and mental disorder.

This Court passed an order on 09.12.2015 directing the petitioner to appear before the Chief Medical Officer, T.T.D., Central Hospital, Tirupathi on 22.12.2015 at 10.30 am while posting the case for further orders on 20.01.2016. Later on, the case was adjourned. Finally when it came on 01.06.2016 before this Court, it was agreed by the petitioner as well as the Standing Counsel for the respondents that if the petitioner appears before the medical board constituted by the Superintendent, Sri Venkateswara Institute of Medical Sciences, the same would be taken into consideration for further action. Accordingly, this Court directed the Superintendent, Sri Venkateswara Institute of Medical Sciences to constitute a medical board on 20.06.2016 at 10.30 am and also directed
the petitioner to appear before it. In pursuance of the same, the petitioner appeared before the medical board on 20.06.2016 and he was advised to be admitted as in-patient for detailed workup. Accordingly, the petitioner was evaluated as in-patient from 20.06.2016 to 27.06.2016. The medical board submitted a report on 27.06.2016 and it reads as follows:

*** It is submitted that as per your directions quoted in the reference cited above, the petitioner Sri Pullela Venkata Satya Surya Srinivasa Rao had appeared before the medical board for examination at SVIMS Hospital, Tirupati on 20.06.2016. Consequently, the medical board constituted at SVIMS Hospital after initial evaluation, had advised the petitioner to be admitted as an in-patient for detailed workup. The above said individual had been evaluated at Psychiatry under vide our Hosp. No.903284 as an in-patient from 20.06.16 to 27.06.16. The medical board report with regard to physical & mental condition of the petitioner is enclosed herewith for your kind attention & further perusal. Thanking you Sir, Yours sincerely

Since the report of the medical board is available, the prayer sought for by the petitioner to the extent of subjecting him to the medical examination is answered. However, with regard to service condition of the petitioner, the concerned administrative authority will take appropriate steps in accordance with law.
