Heard.

So far as mere identity purpose concerned, there is no bar for return of the passport, that too on acquittal pending the appeal, however, if at all to leave the country, a specific permission to obtain transit permission/VISA is required.

With these observations, the revision is allowed, subject to execution of personal bond on Rs.100/- stamp paper for Rs.1,00,000/- (Rupees one lakh only) and undertaking that by virtue of return of the passport not going to travel without permission of the trial Court as the very wording of Section 6(2)(f) of the Indian Passport Act, 1967 and G.O.Rt.No.726 of 1993 speaks of transit permission of the Magistrate here it is the Special Judge concerned.
