THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.7085 OF 2019 Date:08.04.2019 Between:
Rudrapalli Bhagyamma, W/o. Late Bikshapathi, Aged about 58 years, Occ: Housewife, R/o.Madhapur Village, Kanduru Mandal, Ranga Reddy District and others .. Petitioners And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.7085 OF 2019 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. 2.
Petitioners claim that applications were made to carry out corrections in the revenue records reflecting their names to the extent of their share in the joint family property after partition. 3.
Admittedly, material on record does not disclose filing of application for mutation of the names of petitioners in the revenue records in Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971. Unless application in prescribed form is made, it cannot be said that the Tahsildar is not inclined to act upon the application, as alleged in the Writ Petition. Therefore, no relief as sought for by the petitioners can be granted. 4.
Granting liberty to the petitioners to make appropriate application, as required by law, the Writ Petition is dismissed. It is needless to observe that as and when such application is filed, the Tahsildar shall consider the same as expeditiously as possible preferably within a period of six weeks from the date of receipt of such application. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ P. NAVEEN RAO, J Date:08.04.2019 KH
