ORDER:
By holding that the G.O.Ms.No.307, Revenue (Assignment.I) Department, dated 06.06.2013, has no application to the subject properties, interim direction as prayed for was granted by order, dated 18.09.2014, in W.P.M.P.No.34802 of
2014 in W.P.No.27794 of 2014. The prayer sought in W.P.M.P.No.34802 of 2014 was to receive, register and release the documents presented by the petitioners in respect of various extents of land in the survey numbers mentioned therein.
2. Alleging non-compliance of the said order, this contempt case is filed.
3. In response to the notice, counter affidavit is filed by the respondent. The stand of the respondent is that no documents are presented by the petitioners in pursuant to the interim orders passed on 18.09.2014 in W.P.M.P.No.34802 of 2014 in W.P.No.27794 of 2014. Therefore, the respondent has not disputed the orders of this Court.
4. When the matter is taken up, learned counsel for the petitioners submits that the petitioners have presented the documents on 16.03.2015 and, accordingly, the documents were assigned P. Nos.38 and 39 of 2015. Thus, admittedly by the time the contempt case is filed, no document was presented. I, therefore, see no reason to proceed against the respondent under the Contempt of Courts Act, 1971. It is needless to observe that since the documents are already presented, the Sub-Registrar, Bantumilli, Krishna District (respondent), shall comply with the orders.
5. The Contempt Case is, accordingly, closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
