HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.6376 of 2017 ORDER:

This criminal petition is filed, by the petitioner-accused No.1, under Section 438 Cr.P.C., seeking pre arrest bail in Crime No.195 of 2017 on the file of the Station House Officer, Arundelpet Police Station, Guntur Urban Police Station, registered for the offences under Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act (for short, 'the Act').

The facts leading to file the present petition are that the petitioner has been running a lodge in the name and style of Sri Surya Lodge, Brodipet, Guntur. On 19.06.2017, the police raided the lodge of the petitioner and found sex workers in Room Nos.401 and 402. It is the further case of the prosecution that the petitioner procuring sex workers on payment of Rs.1,000/- per day and using their services for prostitution.

The petitioner filed Crl.M.P.No.1388 of 2017 on the file of the III Additional Sessions Judge, Guntur, and the same was dismissed on 14.07.2017.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the State. 5.

A perusal of the record reveals the role played by the petitioner in the commission of the offence. Learned Additional Public Prosecutor submitted that the petitioner was an accused in Crime No.68 of 2016 of Arundelpet Police Station, registered for the offence

punishable under Sections 3, 4 and 5 of the Act and that he is a habitual offender.

Taking into consideration the gravity of the offence alleged to have been committed by the petitioner, this Court is of the considered view that it is not a fit case to grant pre arrest bail to the petitioner. 7.
