O R D E R
This writ petition is filed under Article 226 of the Constitution of India to declare the action of respondents in opening the Rowdy Sheet against the petitioner, as illegal, arbitrary and violative of A.P. Police Standing Order 742 and contrary to the principles of natural justice and consequently direct the respondents 2 to 5, to close the said rowdy sheet, duly considering the representation of the petitioner dated 05.12.2016. Learned counsel for the petitioner submits that this court in similar facts and circumstances in W.P.No.38487 of 2017 dated 15.11.2017, relying on other judgments of this court, gave liberty to the petitioner to file explanation / representation within two weeks from the date of the said order, and the competent authority was directed to examine the same and pass appropriate orders. He submits that since the petitioner has already submitted his representation dated 05.12.2016, the same may be directed to be considered and disposed of in accordance with law. Learned Assistant Government Pleader for Home, does not dispute the same.
Having regard to the facts and circumstances of the case and the submissions of the learned counsel, writ petition is disposed of directing the respondents / competent authority, to examine the representation stated to have been made by the petitioner on 05.12.2016, for closing of the rowdy sheet, in the light of the law laid down by this court in W.P.No.4688 of 2012, which was disposed of on 16.03.2017, and in the judgments
reported in SUNKARA SATYANARAYANA v. STATE OF ANDHRA PRADESH1 and B.SATYANARAYANA REDDY v. STATE OF ANDHRA PRADESH2, and dispose of the same in accordance with law, within a period of two months from the date of receipt of a copy of this order. Interlocutory applications pending, if any, shall stand closed. No costs.
