HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.114 of 2017 ORDER:
Heard both sides.
As the very condition while condoning the delay of 106 days in imposing costs of Rs.25,000/- is highly onerous and unjust to say within the meaning of the impugned order is incorrect and prone to revision affecting the rights for not a bar under Section 397(2) of Cr.P.C.
From the above, the criminal revision case is allowed in part by reducing the costs of Rs.25,000/- to Rs.10,000/- taking into consideration of the beneficiaries are no other than wife and children, to pay to the M.C. petitioners before the lower Court within four weeks from today. Failing which the order of the lower Court holds good without any further reference to this Court. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
