THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO TRANSFER C.M.P. NO.87 OF 2019 ORDER:

This Transfer CMP is filed seeking transfer of H.M.O.P. No.33 of 2018 pending on the file of Senior Civil Judge, Narayanapet, Mahabubnagar District to the court of Senior Civil Judge, Sathupally, Kothagudem District.

The respondent had filed the said O.P. against the petitioner seeking divorce in the court of the Senior Civil Judge, Narayanapet in Mahabubnagar District.

The petitioner contends that she is a resident of Aasannagudem village, Nacharam post of Dhammapet Mandal, Bhadradri, Kothagudem District, that she has a minor child with her and she is at her parents house; and it is difficult for her to go from Kothagudem to Narayanapet in Mahabubnagar District, and she does not have a male person to accompany her for the travel. She also stated that she had filed MC No.1 of 2019 before the Additional Judicial Magistrate of I Class, Satthupally, and the same is pending adjudication.

Counter affidavit has not been filed by the respondent, but the counsel for the respondent states that it would be convenient if the case is transferred to Khammam which is 70 kms away from Sathupally to which place the transfer is now sought.

Since the petitioner is a lady having to take care of a minor child, it would be difficult for her to travel not only to Narayanapet, Mahabubnagar District but even to Khamma District. Since the respondent is any way contesting MC. No.1 of 2019 before the Judicial Magistrate of I Class, Sathupaly, it would also be convenient to him, if

the O.P. No.33 of 2018 on the file of Senior Civil Judge, Narayanapet, Mahabubnagar District is transferred to the court of the Senior Civil Judge, Sathupally in Kothagudem District.

Accordingly, the Transfer CMP is allowed and HMOP No.33 of 2018 on the file of Senior Civil Judge, Narayanapet, Mahabubnagar District is transferred to the court of Senior Civil Judge, Sathupally in Kothagudem District.
