THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE NO.2944 OF 2016 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. challenging the docket order, dated 22-08-2016 in Crl.M.P.No.315 of 2016 in Cr.No.165 of 2016 on the file of the Judl. Magistrate of I Class, Tandur, Ranga Reddy District.

Heard learned counsel for the petitioner and the learned Special Assistant Public Prosecutor.

A perusal of the record reveals that the Station House Officer, Yalal Police Station, Yalal, Ranga Reddy District registered a case in Cr.No.165 of 2016 under Section 11 PCAA, 6 r/w 10 APPSCAPA. The petitioner is not an accused in the above crime. It is the case of the petitioner that he purchased the bulls in Karnataka State and transporting the same to Sanga Reddy. It is the further case of the petitioner that he obtained permission from the Agricultural Market Committee, Karnataka State. 12 bulls belong to the petitioner were seized by the police and kept in Goshala. The petitioner filed a petition under Section 457 Cr.P.C. for release of the bulls and the same was dismissed by the trial Court. Hence, this revision.

A perusal of the record reveals that the petitioner purchased the bulls in Karnataka State and transporting the same to Sanga Reddy after obtaining necessary permission from the Agricultural Market Committee. During the pendency of the revision, out 12 bulls, 3 bulls died in Goshala and the remaining 9 bulls are in Goshala.

Learned Special Assistant Public Prosecutor submitted that the petitioner was transporting the bulls

under valid receipt issued by the competent Agricultural Market Committee.

Both counsel with one voice submitted that in similar set of facts, this Court allowed Crl.R.C.No.2235 of 2016 on 20-09-2016.

Having regard to the facts and circumstances of the case and in view of the order passed by this Court in the above Crl.R.C.No.2235 of 2016, interim custody of the remaining bulls shall be handed over to the petitioner on his furnishing a bond for Rs.1,00,000/- (Rupees one lakh only) with one surety for the like sum to the satisfaction of the trial Court. Further the petitioner shall not sell or alienate the bulls to any third person or to a slaughter house till the disposal of the case. If he intends to sell, he has to make an application before the appropriate Court, in which event the same shall be dealt with in accordance with law. If the petitioner fails to give an account of the bulls during the course of trial, suitable action shall be initiated against him. 8.

With the above direction, the Criminal Revision Case is disposed of. Miscellaneous petitions, if any, pending in this Criminal Revision Case, shall stand closed. _________________________ T.SUNIL CHOWDARY, J DATED: 29.11.2016.
