THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.32410 of 2017 ORDER:

Heard learned counsel for the petitioners and Sri Nimmagadda Venkateshwarlu for the respondent Municipality. The grievance of the petitioners in the present writ petition precisely is that without being preceded by any show cause notice, the respondent Municipality issued the impugned notice, dated 07.01.2017, for removal of the structures.

During the course of arguments, it is submitted by the learned Standing counsel that the said notice may be directed to be treated as show cause notice and it may be kept open for the petitioners to submit their explanation and if such explanation is filed, appropriate action will be taken as per law. Recording the said statement, the writ petition is disposed of, keeping it open for the petitioners to submit an explanation to the impugned notice, dated 07.09.2017, by treating the same as show cause notice, within a period of two weeks from the date of receipt of this order. If any such explanation is submitted within the time stipulated above, the same be considered and appropriate final orders be passed strictly in accordance with law, after giving notice to all the stakeholders. Till then, no coercive action pursuant to the impugned notice shall be taken. Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
