Gangavath Hatchi v. The State Of Telangana, Revenue Department,
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5917 of 2018 ORDER:
In spite of granting time to the learned Government Pleader on 22.02.2018, no instructions were received by him and in the circumstances, this Writ Petition is being disposed of on the basis of averments made in the affidavit filed in support of the petition. 2.
It is the case of the petitioner that her senior paternal uncle was the absolute owner and possessor of land admeasuring Ac.1.20 guntas, situated in Survey No.29/VU of Gandhampalli Village, Bayyaram Mandal, Mahabubabad, having inherited the same from his forefathers. Her uncle's name was recorded in the revenue records as pattadar. Thereafter, he executed a Will in her favour on 02.07.1994 bequeathing the said property. Her uncle died on 14.11.2004. She noticed that in the year 2011 as against the original owner only an extent of Ac.0.17 guntas was shown by showing Ac.1.07 guntas in the name of one Veeramma. In those circumstances, she submitted a representation on 25.03.2015 to the 3rd respondent seeking correction of entries and when no action was taken, she filed W.P.No.8480 of 2017.
Since the leaned Government Pleader raised an objection with regard to the nonsubmission of proper application, the said writ petition was withdrawn and the petitioner submitted a proper application on 15.03.2017 followed by a representation, dated 27.03.2017. When the same was not considered, the present Writ Petition is filed. 3.
Since the grievance of the petitioner related to correction of entries and she already filed a proper application on 15.03.2017, this Writ Petition is disposed of, without deciding the merits of the
case, by directing the 3rd respondent to consider the application of the petitioner, dated 15.03.2017, and pass appropriate orders thereon, within a period of three (03) months from the date of receipt of a copy of this order.
4.
The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
