THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40887 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 and 3 in seeking to remove the temporary erected shed raised by the petitioner on the land of the fourth respondent situated at Sri Venugopala Swamy Temple, Tirumala, without considering the representation made by the petitioner, dated 18.11.2016 and 19.11.2016 without following due process of law as illegal and arbitrary, and consequently to direct the respondents 2 and 3 not to interfere with the petitioner's business.

Heard and perused the material.

Learned counsel for the petitioner submits that the respondents 2 and 3 are trying to remove the shed erected by the petitioner without following due process of law. He further submits that though the representations, dated 18.11.2016 and 19.11.2016 are pending with the respondents 2 and 3, without disposing of the same, they are interfering in the business of the petitioner. A perusal of the material available on record reveals that this Court, by order dated 07.11.2016, permitted the petitioner to make a representation to the respondents 2 and 3, if she is inclined to do so. Hence, the petitioner made representations to the respondents 2 and 3. It is open to the respondents 2 and 3 to pass appropriate orders on the representations made by the petitioner.

This Court is not inclined to pass any orders directing the respondents 2 and 3 to pass appropriate orders on the representations of the petitioner. The respondents 2 and 3 are always at liberty to pass appropriate orders in accordance with law. The writ petition is accordingly disposed of.
