The criminal petition is filed seeking for modification of the order in CRLMP.No.248 of 2018 in CRLA.No.52 of 2018 dated 31.01.2018 passed by the Metropolitan Sessions Judge, Hyderabad insofar as directing the petitioner herein to deposit half of the cheque amount. 2.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that out of Rs.9,00,444/ - Rs.5,000/ - was directed to be adjusted as fine to the State exchequer and the rest of the fine amount of Rs.8,95,444/ - was awarded as compensation to the complainant and it is only for suspending the order, the Court below has imposed the above condition, which is onerous.

The Court finds some force in the said argument.

Hence, considering the above, this Court opines that the order passed by the Court below needs to be modified by directing the petitioner to deposit 10% of the cheque amount in stead of 50% as directed by the Court below.
