HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.537 of 2016 ORDER:

The petitioner was the Panchayat Secretary and a Government employee. The grievance of the petitioner is with reference to payment of retirement benefits. It being a service matter the jurisdiction is vested in the Andhra Pradesh Administrative Tribunal (APAT) constituted under Administrative Tribunals Act, 1985. The petitioner has to avail the remedy as available under the Administrative Tribunals Act, and cannot directly invoke the jurisdiction of this Court as held by the Hon'ble Supreme Court in L. Chandra Kumar Vs Union of India[1]. The Tribunal being the Court of first instance, an aggrieved employee cannot directly invoke the jurisdiction of this Court.

2. Having regard to the above, the Writ Petition is dismissed granting liberty to the petitioner to avail the remedies as available under the Administrative Tribunals Act, 1985. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
