THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.795 OF 2016 ORDER:
This Contempt Case was instituted alleging willful disobedience to the order dated 03.3.2016 passed in W.P.No.6910 of 2016. By the said order, the impugned Memo dated 14.12.2015 was set aside and the matter was remitted to the file of the appellate authority for hearing of the appeal afresh in accordance with law and disposal of the same within a time frame. Alleging disobedience to the aforestated order, this Contempt Case was instituted.
The Principal Secretary to Government, Home (Arms) Department, Government of Telangana, filed a counter affidavit stating that after receipt of the aforestated order, the petitioner was requested to appear before the appellate authority on 31.8.2016 and after giving due opportunity of hearing to him, final orders were passed, vide Government Memo No.2890(P)/Arms/2016 dated 02.9.2016.
In the light of the aforestated facts, this Court finds no grounds to exercise contempt jurisdiction in the matter. The Contempt Case is accordingly dismissed. No order as to costs. ----------------------- SANJAY KUMAR, J.
