This petition is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking for modification of the order dated 04-12-2017 in Criminal M.P.No. 260 of 2017 in Criminal Appeal No. 1265 of 2017 on the file of the Court of VIII Additional Sessions Judge, Ranga Reddy District (for short, 'the Court below'), by virtue of which the Court below directed the petitioner-appellant to deposit Rs.1,25,000/ - from out of the compensation amount, while suspending the sentence imposed against the petitioner in C.C.No. 23 of 2017 on the file of the Court of VI Special Magistrate at Hasthinapuram, L.B. Nagar, R.R. District.

Learned counsel for the petitioner submits that the petitioner is suffering from heart ailment and is not in a position to pay the said amount. He seeks for modification of the said order by reducing the amount to 10% of the cheque amount. 3.

Hence, considering the above, the condition is modified to the effect that the petitioner shall deposit 10% of the compensation amount which comes to Rs.74,000/ -. 4.

Subject to the above, the criminal petition is allowed. Pending miscellaneous petitions if any shall stand closed in consequence.
