HON'BLE SRI JUSTICE A. SHANKAR NARAYANA M.A.C.M.A.No.28 of 2009 JUDGMENT :

As seen from the proceeding sheet, as there was no representation for the appellants on 04.02.2013, the matter was directed to be listed on 05.02.2013 under the caption "FOR DISMISSAL". When the matter was listed on 07.02.2013, perhaps, at request of the learned counsel for appellants, the matter was removed from the caption "FOR DISMISSAL", while directing to post next week. Again it was listed on 13.06.2016 and as both parties reported not ready, it was directed to be listed on 22.06.2016, on which date the arguments of the learned counsel for respondent were heard and the matter was directed to be listed on 24.06.2016 for hearing the appellants. When the matter was listed on 20.07.2016, as there was no representation for the appellants, it was directed to be listed next week under the caption "FOR DISMISSAL".

2. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellants. It appears that the appellants are not interested in pursuing the matter.

3. Hence, the Civil Miscellaneous Appeal is dismissed for nonprosecution. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
