HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.37509 of 2015 Date:18.11.2015 Between:
Jangili Venkata Koteswara Rao, S/o Venkaiah ..... Petitioner And:
The State of A.P.., reptd., by its Principal Secretary, Panchayat Raj Department, Hyderabad and four others.
.....Respondents Counsel for the Petitioner: Mr. K.Ananda Rao Counsel for Respondent Nos.1, 3 & 4: AGP for Panchayat Raj (AP) Counsel for Respondent No.2: AGP for Revenue (AP) The Court made the following:
ORDER:
Proceedings in Roc.No.588/2015(Pts.)A8, dated 18.10.2015, of respondent No.3, whereby he has denuded the petitioner of the cheque drawing power until a final order on the charges framed against him is passed is questioned in this Writ Petition. From a perusal of the impugned proceedings, it is evident that taking away the cheque drawing power from the petitioner is done as an interim measure pending passing of a final order. Hence, I am not inclined to interfere with the exercise of this power by respondent No.3. However, if the petitioner has submitted his explanation to the charges on 09.5.2015, respondent No.3 is directed to hold an enquiry into the same, wherein he shall give an opportunity of personal hearing to the petitioner and pass a final order within one month from the date of receipt of a copy of this order.
Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, W.P.M.P.No.48248 of 2015 shall stand disposed of as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 18th November, 2015 DR
