THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19283 OF 2016 O R D E R :

Heard learned counsel for the petitioner.

The petitioner was stated to be the fair price shop dealer of Shop No. 27, Veerapur Village, Kulakacherla Mandal, Ranga Reddy District. On 25.05.2016, his authorization was suspended pending inquiry, by the 3rd respondent Revenue Divisional Officer, Chevella Revenue Division on the ground that certain variation of stock has been noticed.

The allegations made against the petitioner are that there is variation of rice (excess) to the extent of 40.35 kgs. and that he is distributing less stock than mandated under the Rules. A show cause notice dated 13.05.2016 was also issued to the petitioner. Learned Government Pleader for Civil Supplies (Telangana) would submit that the petitioner has not submitted any explanation to the show cause notice and if he does so, the 3rd respondent would conduct the inquiry and pass appropriate orders thereon. In view of the submission made by the learned Government Pleader, though the petitioner has not responded to the show cause notice so far, in the interests of justice, if he submits his explanation, the 3rd respondent is directed to conduct the inquiry after taking the same into account and after following the principles of natural justice, and complete the same within a period of three weeks from the date of receipt of a copy of this order.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
