Petitioner And The State of Telangana, Rep., by the Principal Secretary, Revenue Department, Secretariat, Hyderabad & others.
.. Respondents This court made the following :
- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.7189 OF 2019 ORDER :
Heard learned counsel for petitioner and learned Government Pleader for Revenue for respondents. 2.
Petitioner is aggrieved by the decision of Tahsildar, dated 15.02.2018, where under the request of petitioner for issuance of pattedar pass books and title deeds over the land to an extent of Ac.1-36 guntas in Sy.No.558 and Ac.1-12 guntas in Sy.No.560 of Elagandula Village, is rejected.
3.
Against the decision of Tahsildar, remedy of appeal is provided under Section 5 (5) of the A.P.Rights in Land and Pattedar Pass Books Act, 1971 (for short 'the Act'). However, such appeal has to be preferred within 60 days. However no appeal was preferred and after more than one year this writ petition is filed.
4.
Though the remedy of appeal is exhausted and limitation prescribed is already over, under Section 9 of the Act, petitioner can as well prefer appeal pointing out illegalities in considering the application as agitated in this writ petition. 5.
Thus, leaving it open to the petitioner to avail the remedy of revision provided under Section 9 of the Act, the Writ Petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed.
