THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.218 of 2016 ORDER:

1. This Criminal Revision Case is filed by the petitioner-Accused aggrieved over the order dated 03.12.2015 passed in Crl.M.P.No.7440 of 2015 in C.C.No.247 of 2011 by the Additional Judicial Magistrate of First Class, Jaggayyapeta.

2. It is alleged that the petitioner-accused committed the offence punishable under Section 138 of the Negotiable Instruments Act. As the petitioner failed to appear before the learned Magistrate, NBWs were issued against him on 5.12.2013. On 18.11.2015, the trial Court issued a memo to the Station House Officer concerned for nonexecution of NBWs issued against the petitioner. Subsequently, the petitioner filed the above Crl.M.P. seeking to recall NBWs issued against him. The trial Court dismissed the above Crl.M.P. Aggrieved by the same, the petitioner-accused filed this revision.

3. Heard and perused the material available on record.

4. Considering the facts and circumstances of the case, the petitioner is directed to surrender before the learned Magistrate and move an application afresh to recall NBWs issued against him. On such application being filed, the learned Magistrate is directed to recall NBWs issued against the petitioner on condition of his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the learned Magistrate. The petitioner is further directed to appear before the learned Magistrate on all hearing dates.

5. Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
