This Writ Petition is filed for the following substantive relief. "...to declare the action of the respondent authorities 1 to 5 in issuing the B.C. 'C' Community Certificate, as illegal, arbitrary and consequently to direct respondent No.5 to conduct the fair enquiry regarding the original Caste Certificate of respondent No.6 and cancel the community nativity/BC issued by respondent No.5 in favour of respondent No.6 after conducting proper enquiry by giving an opportunity to respondent No.6 and initiate necessary action against respondent No.6 and his family members for availing Government Schemes provided for the Schedule Caste people."
After arguing the case, Sri B.V.S.S.Bala Krishna Ranjit, learned counsel for the petitioner, seeks permission of the Court to withdraw the Writ Petition with liberty to his client to file fresh Writ Petition with proper pleadings and material papers.
Accordingly, the Writ Petition is dismissed as withdrawn with liberty to the petitioner in terms of the prayer made. As a sequel to dismissal of the Writ Petition, WP.MP.No.48556 of 2013 filed by the petitioner for interim relief shall stand disposed of as infructuous.
