SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2191 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioners, who are accused Nos.4 to 7, in Crime No.20 of 2018 on the file of the Station House Officer, Pullampet Police Station, Kadapa District.

The offences alleged are under Sections 147, 148, 379, 307, 353, 109 and 120(b) R/w.149 of I.P.C., Section 20(1)(c)(ii)(iii)(iv)(vi) & (x) of Forest Act, 2016, Section 20(d)(i)(a)(b) and Section 29(2)(b)(4)(a)(I)(II)(b) and Section 44(2) of A.P. Forest Act, 1967, Rule 3 of A.P. Sandal Wood and Red Sanders Wood Transit Rules, 1969 and Section 51 of the Prevention of Damage to Public Property Act, 1984. 3.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

The petitioners' counsel contends, that though the case of the prosecution is that the petitioners were engaged in transportation of red sanders and pelted stones against the Police, who went to apprehend them, there is no material, directly linking these petitioners with the alleged offences, and it is only through the confession of accused Nos.1 and 2, the names of these petitioners came to light. 5.

Learned Public Prosecutor, however, contends that the investigation is still in progress and the nexus of the petitioners with the alleged offences is yet to be discovered.

Hence, in the above circumstances and considering the nature of allegations, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
