HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44508 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the 3rd respondent in not taking any action against the land grabbers, not following the injunction orders, dated 25.10.2016, in I.A.No.850 of 2016 in O.S.No.686 of 2016 in not providing the police assistance/police aid to follow the injunction orders, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that the petitioner is the absolute owner and possessor of Plot No.14, to an extent of 250 square yards in Survey No.79/E, situated in Peerzadiguda Village, Ghatkesar Mandal. On 24.11.2016, one K. Ramesh and Vinod Kumar, by engaging unsocial elements, came to the petitioner's property at about 5.00 p.m. and damaged the boundary wall and break opened the door of room in the property, in spite of the injunction orders passed in favour of the petitioner in I.A.No.850 of 2016 in O.S.No.686 of 2016, vide order, dated 25.10.2016, and on knowing the same, when the petitioner rushed to the property, the said Ramesh and Vinod attacked him and abused in filthy language and threatened him with dire consequences. The main grievance of the petitioner is that the petitioner made a representation, dated 24.11.2016, to grant police protection to the petitioner to protect his property and life and liberty to the 3rd respondent, but the 3rd respondent has not taken any action against the trespassers.

Considering the grievance of the petitioner, the 3rd respondent is directed to consider the representation, dated 24.11.2016, of the petitioner and it is left open to the 3rd respondent to give police protection to the petitioner in respect of his subject property, if there is any necessity. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
