THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.12269 of 2016

ORDER

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.358 of 2016 of Special Judicial First Class Magistrate for Prohibition & Excise, Guntur.

2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor representing the State.

3. Having perused the material on record, it is evident that it is not a fit case to quash the proceedings. However, on the submissions of the learned counsel for the petitioners, this Court feels it appropriate to direct the Court below to dispose of the C.C. itself as expeditiously as possible.

4. In that view of the matter, the Criminal Petition is disposed of directing the Special Judicial First Class Magistrate for Prohibition & Excise, Guntur, to dispose of C.C.No.358 of 2016, within a period of six(6) months, without insisting the presence of petitioners/A1 and A2 on each and every adjournment, unless the learned Magistrate feels that their presence is necessary for any specific purpose. Petitioner No.3/A3 shall appear before the trial Court during the course of trial.

5. With the above directions, the Criminal Petition is disposed of.

6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
