THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 8259 of 2017 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code seeking to quash the proceedings in C.C.No.365 of 2011 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad. The charge sheet came to be filed against the petitioner and others for an offence punishable under Section 498(A) of IPC. Pending the said proceedings, the informant filed a compromise petition under Section 320 of Cr.P.C., seeking compounding of the offence alleged against the petitioner.

Today, when the matter was taken up, the informant and the power of attorney holder of A1, who is A2, are present before the Court. Both the parties were identified by their respective counsel. On examination, the second respondent- de facto complainant by name Smt.Sabeena Tabassum stated that at the instance of elders and well wishers of the family, both the parties have compromised the matter and she is not interested to prosecute the case and has no objection for quashing the proceedings. The affidavit filed by the second respondentde facto complainant before the Court affirms the same. It is also brought to the notice of the Court that Crl.P.No.7373 of 2014, filed against A2 to A8 for compromise was also allowed. In view of the compromise between the parties, the possibility of conviction being remote and bleak and as such the continuation of criminal proceedings would be an abuse of process of law. Crl.P.No.8259 of 201 consideration the facts and circumstances of the case and as no useful purpose would be served in allowing the proceedings to continue, I am inclined to allow the criminal petition.

In view of the compromise arrived at, the Criminal Petition is allowed and the proceedings in C.C.No.365 of 2011 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad against the petitioner/ A1 are hereby quashed.

As a sequel, Miscellaneous Petitions, if any pending, shall stand closed.
