HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No. 5257 OF 2001 ORDER:
This Writ Petition is filed in the year 2001. On 28.03.2001, this Court while admitting the Writ Petition, directed the respondents to continue the petitioner in service, if she is continuing in service as on that date. On 17.07.2006, on the representation that Special Leave Petition filed by the respondent-corporation was pending before the Hon'ble Supreme Court, this Court directed that the matter be posted after disposal of the Special Leave Petition. Thereafter, the matter has appeared in the cause list on 11.08.
2016, on which date, learned counsel on either side were not present, and even there was no representation on their behalf, as such the matter was directed to be posted after two (2) weeks, under the caption 'Final hearing' with a direction to the petitioner to inform whether the Special Leave Petition, preferred by the respondentcorporation, is still pending before the Supreme Court, if not, what is its result, for taking further steps in the matter. In spite of the same, none appeared for the petitioner on 27.08.2016; hence, the matter was directed to be posted to today under the caption 'For dismissal'. Even today also, there is no representation for the petitioner. This is a case pertaining to the year 2001 and it has reached only recently for hearing.
Despite affording sufficient opportunity to the petitioner to represent the matter and to inform about the status of lis pending before the Supreme Court, he did not do so. It shows that the petitioner is not interested in prosecuting the case.
GSP, J W.P. No.5257/2001 Therefore, the writ petition is dismissed for non-prosecution. In consequence, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed. No order as to costs.
