THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.474 of 2014 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the third respondent to dismantle the illegal construction of third respondent's house encroaching five feet of the petitioner's land.

2. The learned counsel for the petitioner, through letter dated 26.7.2016 addressed to the Registrar (Judicial), has sought permission of this court to withdraw the writ petition with liberty to the petitioner to file a civil suit in competent court. Permission is granted to the petitioner to avail all the remedies available to him under law including filing of a civil suit.

3. Accordingly, the writ petition is dismissed as withdrawn. Miscellaneous petitions if any pending in this writ petition shall stand closed.
