THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.5883 of 2018 Order:

This writ petition is filed challenging the notice issued under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 1977, dated 06.02.2018, and served on the petitioners between 10.02.2018 and 13.02.2018, which did not disclose any cause of action. When the matter is taken up for consideration, learned Government Pleader, on the basis of written instructions, submits that the notice was wrongly issued without filling up the particulars and it required issuance of fresh notice.

In view of the statement made by the Tahsildar in his written instructions issued to the learned Government Pleader, this Writ Petition is allowed setting aside the notice dated 06.02.2018, but, however, it will not prevent the third respondent from issuing fresh notice in accordance with law.
