ORDER
This petition under Section 482 Cr.P.C., is filed by the petitioner against the order dated 24.03.2015 passed in Crl.M.P.No.380 of 2014 in C.C.No.100 of 2010 on the file of the Judicial First Class Magistrate at Thorrur.
2. The respondent-State filed Crl.M.P.No.380 of 2014 in C.C.No.110 of 2010 seeking to receive the document in order to prove the marital relationship of P.W.1 with A1. The trial Court, after considering the material on record, allowed the said petition. Challenging the same, the petitioner filed the present criminal petition.
3. As seen from the record, A1 disputed the marital relationship with P.W.1, as such, the relevant document, wherein the 1st wife of A1 averred in the O.P. that P.W.1 is the wife of A1 as he married her, is filed by P.W.1 in order to ascertain her marital status with A1, and therefore, the impugned application is filed. The trial Court has rightly allowed the said petition to give reasonable opportunity to prove the case. Therefore, I find that there are absolutely no grounds to interfere with the impugned order.
4. Hence, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand dismissed. ________________ M.S.K.JAISWAL, J 12th June, 2015 sj
