HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.150 OF 2016 ORDER:

This application is filed to withdraw O.P.No.983 of 2015 from Family Court, Ranga Reddy District at L.B.Nagar and transfer the same to Senior Civil Judge Court, Shad Nagar, Mahabubnagar.

Wife filed this application contending that her marriage with respondent was performed on 8-6-2014 at M.M.R.Garden, Adarsh Nagar Colony, Shamshabad village, Ranga Reddy District and thereafter, disputes arose between them and she filed Criminal case D.V.C. and maintenance case against respondent and respondent has filed O.P. for restitution of conjugal rights. She stated that O.P. is filed only with a view to harass her and she apprehend danger if she is enter into matrimonial house of respondent for restitution of conjugal rights. She prayed for transfer of O.P. from Family Court, Ranga Reddy District at L.B.Nagar to Senior Civil Judge Court, Shad Nagar, Mahabubnagar on the ground that three other cases are pending.

Husband filed counter disputing averments of petitioner and contended that there is a life threat for him if

the proceedings are conducted at Shad Nagar, Mahabubnagar District.

The other contentions of affidavit averments and counter affidavit are in respect of merits and demerits of the petition filed for restitution of conjugal rights. Heard both sides.

The fact that three cases are pending at Shad Nagar, Mahabubnagar is not in dispute but the husband mainly contended that he has life threat at Shadnagar. Considering the same, I feel that it is proper to transfer case to Family Court, Mahabubnagar District for disposal in accordance with law.

For these reasons, O.P.No.983 of 2015 is withdrawn from Family Court, Ranga Reddy District at L.B.Nagar and transferred to Family Court, Mahabubnagar for disposal in accordance with law. Family Court, Mahabubnagar shall dispose of the case as expeditiously as possible. Accordingly, this petition is ordered. No costs. As a sequel to the disposal of this petition, Miscellaneous Petitions, if any, pending, shall stand dismissed.
