HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.324 of 2016 ORDER:

This petition is filed to transfer divorce O.P.No.37 of 2016 from the file of Principal District Judge, Chittoor, to Principal District Judge, Ananthapur.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 22.01.2015 at Tadipatri, Anantapur District and that she lived with respondent at T.Kothuru Village for about one week and thereafter respondent and his relatives started harassing her and unable to bear the harassment she came back to her parents' house Tadipatri. She stated that she filed M.C.No.9 of 2015 before Judicial First Class Magistrate, Tadipatri and respondent filed counter and contesting the same. She further stated that she gave a report to police and the same is registered as Crime No.164 of 2015 on the file of Tadipatri Police Station, the said case is still pending.

She stated that in order to harass her respondent filed divorce O.P. before Principal District Judge, Chittoor and distance between Chittoor and Anantapur is about 300 kms. and that there is no direct bus or train between these two places. She stated that she has to change buses or train at Renigunta. For these reasons, she prayed for transfer of divorce O.P. from Principal District Judge, Chittoor to Principal District

Judge, Anantapur.

This Court permitted petitioner to take personal notice to respondent through registered post with acknowledgment due and in compliance of the said order, advocate for petitioner filed memo dated 27.07.2016 stating that notice sent to respondent is duly served and filed postal acknowledgment along with memo. In spite of service of notice respondent neither appeared in person nor through any Advocate.

4. Considering the reasons stated in the affidavit and also considering the convenience of wife, divorce O.P.No.37 of 2016 is withdrawn from Principal District Judge, Chittoor, and transferred to Principal District Judge, Anantapur, for disposal in accordance with law.

5. Transfer C.M.P. is ordered accordingly.

6. Miscellaneous petitions pending, if any, shall stand closed.
