HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.308 of 2016 ORDER:

This petition is filed to withdraw O.P.No.15 of 2016 from the Court of Senior Civil Judge, Bhongir, Nalgonda District to III Additional Family Court, Malkajgiri, Ranga Reddy District.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was held on 28.11.2004 at C.K.Gardens, Nacharam, Ranga Reddy District as per Hindu rights and caste customs. She stated that marriage was consummated and there are no issues.

She also stated that respondent filed O.P.No.1155/2014 under Section 9 of Hindu Marriage Act before Family Court, Ranga Reddy District and thereafter she appeared before Family Court and contested the matter. Both of them executed a MOU. She further stated that as she came to know that respondent played fraud upon her she filed MC.No.119 of 2015 on the file of Family Court, Ranga Reddy District and thereafter, it was transferred to III Additional Judge, Family Court at Malkajgiri, Ranga Reddy District. She stated that respondent intentionally filed O.P. at Bhongir and it is difficult for her to travel from Hyderabad to Bhongir because of her financial position. She also stated that she has life threat from respondent at Bhongir. For these reasons, she prayed for transfer of O.P.No.15 of 2016 from the Court of Senior Civil Judge, Bhongir, Nalgonda District to III Additional Family Court, Malkajgiri, Ranga Reddy District.

This Court permitted petitioner to take out personal notice to respondent through registered post with acknowledgment due and in compliance of the said order, a memo is filed on 13.07.2016 stating that the notice sent to respondent is delivered on him on 08.07.2016 as per track report of the postal department. In spite

of that the respondent neither appeared in person nor through any advocate

Considering the reasons stated in the affidavit and also considering convenience of wife and also the fact that M.C. filed by wife is pending before III Additional Family Court at Malkajgiri, Ranga Reddy District wherein the respondent is appearing, O.P.No.15 of 2016 is withdrawn from the Court of Senior Civil Judge, Bhongir, Nalgonda District to III Additional Family Court, Malkajgiri, Ranga Reddy District, for disposal in accordance with law.

6. Accordingly, transfer C.M.P. is ordered.
