THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.32940 of 2015 ORDER:

The petitioners are aggrieved by the demand notice dated 14.09.2015 issued by the Assistant Director of Mines and Geology, Vigilance, Sangareddy, Medak District, wherein the Assistant Director noted that the petitioners had failed to submit their explanation to the show cause notice dated 30.07.2015. This statement is factually incorrect as the petitioners' explanation dated 13.08.2015 was acknowledged by the office of the Assistant Director of Mines and Geology, Vigilance, under signature dated 13.08.2015. The authority therefore did not consider the said explanation and issued the impugned demand notice. In that view of the matter, the writ petition is disposed of keeping the impugned notice dated 14.09.2015 in abeyance. The 3rd respondent shall consider the petitioners' explanation dated 13.08.2015 and thereafter take appropriate action in the matter. It shall be open to the said authority to modify, cancel or confirm the demand notice dated 14.09.2015.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
