HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.19451 OF 2007 O R D E R :

The petitioners are the owners and possessors of the property to an extent of 1872.22 sq.yards and 1182.40 sq.yards, total of 3,054.62 sq.yards, forming part of survey Nos. 97 and 98, Fathenagar village, Kukkatpalli Municipality, Balanagar, Ranga Reddy district, which was the subject matter of the judgment and decree dated 23/1/1998 in O.S.No. 201 of 1995 on the file of the Court of II-Additional Senior Civil Judge [II-Additional Subordinate Judge], Ranga Reddy district. That out of the above land, an extent of 1500 sq.yards was acquired for the purpose of 'stream water drain', which passes through their land to Jinkalawada and the respondents constructed a nala. The said action was without awarding any compensation to the petitioners. The petitioners made several requests before the respondents but there was no action initiated by the respondents to award compensation.

Finally on 31/01/2007 also the petitioners represented before the respondents.

2. The respondents have not filed any counter. That having acquired the land of a citizen and that too without paying compensation and that too when the petitioners have represented the matter, it reflects upon the attitude of the concerned officers. More so, not filing their counter-affidavit in the writ petition also cannot be appreciated.

3. The respondents are directed to decide the subjectmatter on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

4. With the above observation, the writ petition is disposed of. No costs.

5. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stands closed.
