The criminal petition is filed seeking for modification of the order in CRLMP.No.272 of 2018 in CRLA.No.53 of 2018 dated 29.01.2018 passed by the Metropolitan Sessions Judge, Hyderabad insofar as directing the petitioners herein to deposit half of the cheque amount. 2.

Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that no compensation was awarded but fine was imposed and it is only for suspending the order, the Court below has imposed the above condition, which is onerous.

The Court finds some force in the said argument, as only Rs.19,000/ - out of Rs.20,000/ -, ordered as fine, was directed to be paid to the defacto complainant. Hence, considering the above, this Court opines the order passed by the Court below needs to be modified by directing the petitioners to deposit 10% of the cheque amount in stead of 50% as directed by the Court below. The criminal petition is allowed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. __________ T.
