HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.15709 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as follows: "... to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in calling the petitioner and others under the guise of registration of FIR No.70 of 2012 of 5th respondent and the statement of 6th respondent recorded under Section 164 of Cr.P.C. by the Court of II Additional Chief Metropolitan Magistrate, Hyderabad is as illegal, arbitrary, whimsical, unjust, without jurisdiction or authority besides violative of valuable rights under Article 14, 21 of the Constitution of India and sheer abuse of process of Courts and law and consequently direct the respondents not to call the petitioner to the police station and arrest the petitioner in pursuance of Crime No.70 of 2012 of 5th respondent and statement under Section 164 of Cr.P.C. of 6th respondent recorded by the Court of II Additional Chief Metropolitan Magistrate in the interests of justice."

Learned Government Pleader appearing for respondent Nos.1 to 5 filed written instructions dated 02.07.2014 issued by the Sub-Inspector of Police, Golconda Police Station, Hyderabad.

From a perusal of the said instructions, it is evident that Crime No.70 of 2012 pertains to Banjara Hills Police Station, Hyderabad. The contention of the petitioner that under the guise of the said crime he is being called to the Golconda Police Station is not correct and baseless. That apart, the learned Government Pleader also placed on record a copy of death certificate dated 29.12.2014. From the said certificate it is evident that the petitioner died on 18.12.2014

itself. Therefore, on both counts, no further cause would survive in the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs.

Miscellaneous petitions, if any, shall also stand dismissed.
