HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 14991 of 2005 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in transferring the petitioners from Kavali to Kagajnagar vide proceedings dated 20.04.2005, as illegal and arbitrary.

A perusal of the record discloses that vide orders dated 12.07.2005, this Court directed the respondents to continue the petitioners at Kavali and it is almost 14 years since this Court passed the interim orders. This Court is of the considered view that no employee has right to continue at one particular place. Therefore, this Court is not inclined to interfere with the orders of transfer, however, it is always open for the respondents to pass appropriate orders in respect of posting the petitioners according to the exigency and administrative convenience.

With the above observation, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 28th December, 2018 cbs
