Heard Sri Akula Mahesh Kumar, counsel for the petitioner and Sri Bankatlal Mandhani, counsel for the 1st respondent. In this Revision, an order dt.20-10-2014 in I.A.No.435 of 2013 in O.S.No.44 of 2012 of II Additional Senior Civil Judge, Ranga Reddy District is questioned. The petitioner is 5th defendant in the suit. He filed said application for amendment of written statement. The said application has been rejected without assigning any reason by merely observing that no case is made out for amendment of the written statement.

In this view of the matter, I am of the opinion that the impugned order cannot be sustained.

Accordingly, Civil Revision Petition is allowed and order dated 20-10-2014 in I.A.No.435 of 2013 in O.S.No.44 of 2012 of II Additional Junior Civil Judge, Ranga Reddy District is set aside and the said I.A. is remanded back to the said Court to pass a reasoned order afresh, after hearing both sides. No costs.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
