CVNR, J & MSKJ, J WP 23865/2016 ORDER: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus to produce one Kummari Raghu, husband of the petitioner, from detention, by setting aside the order of detention.
At the hearing, learned counsel for the petitioner submitted and the same is admitted by the learned Government Pleader for Home (TS) that Writ Petition No.21465 of 2016 filed by one Navaneetha on behalf of one Karna Raju, accused No.2, in the all the offences in which the detenu in the present case is shown as accused No.3, was allowed by this Court by order dt.16.11.2016 and the detention order against said Karna Raju was set aside. Since the offences registered against the detenu in the present case and the said Karna Raju are common and the writ petition filed on behalf of the latter having been allowed, the order of detention in this case is also liable to be set aside.
The writ petition is accordingly allowed and the detention order dt.21.1.2016 of respondent No.2, which was confirmed by respondent No.1 in G.O. Rt. No.757, General Administration (Law & Order) Department, dt.30.3.2016, is set aside. The detenu is directed to be released from the detention forthwith, if he is not required in any other case.
As a sequel to disposal of the writ petition, W.P.M.P. No.37926 of 2016 shall stand disposed of as infructuous.
