THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3984 of 2010 ORDER:
This Writ Petition is filed challenging the inaction of the third respondent in taking action on the complaint lodged by the petitioner on 08.01.2010 in the case of death of one person and for a consequential relief to entrust the investigation of Crime No.200 of 2009 dated 24.12.2009 on the file of the P.S II Town Nellore to any other investigating officer.
The learned Government Pleader, on the basis of written instructions, submits that based on the complaint dated 24.12.2009, as many as 8 witnesses were examined and their statements were recorded. At the request of the petitioner/complainant the investigation was entrusted to the Inspector of Police, Nellore Town, vide proceedings dated 27.02.2010. During the course of investigation it came to light that the complainant's daughter committed suicide due to the harassment and abetment of the husband and family members. Hence, the Section of law was altered from Section 174 Cr.P.C to Sections 498-A and 306 IPC. A charge sheet was filed on 20.10.2010 and the case is pending trial in S.C.No.75 of 2012 before the learned I Assistant Sessions Judge, Nellore.
In view of the above facts, no further adjudication is necessary in the present case and the Writ Petition is closed. It is needless to observe that it is open to the petitioner to take necessary steps before the Sessions Court where the case is pending for adducing any evidence or for seeking proper relief from the same Court. The miscellaneous petitions pending in this Writ Petition, if any, shall also stand closed. There shall be no order as to costs.
