THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.16635 of 2001 ORDER:
This writ petition is filed seeking to issue a writ of Certiorari calling for the records pertaining to order dated 22.06.2000 in E.P.No.16 of 1998 in I.D. No.231 of 1990 on the file of the Industrial Tribunal cum Labour Court, Warangal.
2. Heard the learned Government Pleader for Irrigation and Sri A.K.Jayaprakash Rao, learned counsel for the 1st respondent.
3. The case in brief is that the 1st petitioner worked as a Pump Operator in the A.P. State Construction Corporation Limited. He was terminated from service on 06.08.1979. Aggrieved by the termination order, the petitioner filed I.D. No.231 of 1990 before the Tribunal. The Tribunal passed an award directing reinstatement of the petitioner with continuity of service and back wages. Aggrieved thereby, the Department filed W.P. No.3372 of 1995. This Court disposed of the said writ petition by confirming the relief of reinstatement with continuity of service, but denying the relief of back wages. The 1st respondent filed E.P. No.16 of 1998 for implementation of the Award with respect to wages due to him and sought payment of Rs.2,09,307/ -.
4. Learned counsel for the petitioners submits that the Award passed in I.D.No.231 of 1990 dated 19.02.1991 was modified in W.P. No.3372 of 1995 vide order dated 07.11.1998 granting reinstatement of the workman with continuity of service, but denying backwages, and that the said order was complied with and the workman was continued in service and he has retired from service during the pendecy of the present writ petition. It is further submitted that the petitioners have
paid Rs.1,00,000/ - to the workman as compensation for the period from the date of publication of the award till reinstatement of the workman into service.
5. In view of the above, nothing survives for adjudication in the present writ petition.
6. Hence, the Writ Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs.
