HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.13452 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Fisheries for respondents.

2. This Writ Petition was filed challenging the action of the respondents in interfering with the repairing work of existing fish tank in an extent of Acs.5-77 cents in R.S.No.178 of Roluopadi Village, Tiruvuru Mandal, Krishna District.

3. It is the case of the petitioner that he is the absolute owner of the said land and he submitted an application to the second respondent in application No.1317 dated 15.06.2013 in accordance with G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries (Fish.II) Department, dated 16.03.2013. The petitioner did not receive any communication and pending consideration of that application, the third respondent is interfering with his land.

In the circumstances, this Court feel that since the petitioner did not have any registration in his favour for conversion of his agricultural land for aquaculture activity, the petitioner is given liberty to file an appropriate application to the District Level Committee appointed under G.O.Ms.No.7, dated 16.03.2013, within a period of 15 days from the date of receipt of a copy of this order and the District Level Committee shall consider the same and pass appropriate orders thereon within a period of three months thereafter.

5. The Writ Petition, is accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _______________________________ A. RAMALINGESWARA RAO, J Date: 16.06.2015
